We recently had some issues with content being scraped from our site and republished on a corporate blog. The company claims that since we are publishing an RSS feed, that opens our content up to be openly republished without permission.

I'm no legal expert - and that may very well be 'technically' true.

Most online publishers use RSS feeds and there is at least a silent understanding of their purpose. But is there truth behind the company's assertion and, if so, what does that mean for the millions of websites publishing RSS feeds out there?

Personally, if they give credit, citing author and blog, I would not have a problem with it. Might even be kind of flattering. If it is shared in full disclosure and in a positive light, you win because what you said mattered. IMHO.

When I first launched my blog, I had this out a little with Robert Scoble and a number of other A list bloggers because of their active support of Google Reader, and sharing content.

There is all kinds of data that can be transmitted by RSS, and some of it also requires RSS Authentication (not supported by Google Reader)

No one can say whether it is 100% legal or not, because it has never been tested in court.

I publish all my content licensed as GPL, but ask people to link back to the original article. It actually works fairly well, though sometimes sites like WebProNews do steal my SERPS, but only because they use a different variant of the article title, so I might not have got the article read anyway.

Include lots of links to your own content and make use of the syndication.

Excerpts from RSS feeds are displayed with Adsense alongside on Technorati.

As long as the article links back to the author and the "scraper" site is not claiming ownership, that is no different to what Technorati does.

Treat it as a free link.

With the amount of scrambled content on these sites, it is highly unlikely that they will outrank you for your own content.
