MSN and Yahoo! used to use these by default, simply as a blanket legal protection. I suspect the same applies to Facebook, too.

The thing that I found the most interesting, that I didn’t realize was the application of this ToS with the 3rd party plugins. That’s why I took my flickr and my flogblog application down. I guess when I was installing the aps, I figured that the ToS of the other sites carried over, but after reading Facebook’s ToS, it certainly doesn’t work that way. :(

Facebook is not the only service to make a rights grab at content. The terms of Ning are unfair.
