I've seen mixed reports about court rulings where the issue is bidding on a competitor's brand.  Is there a recent court case that addresses this issue.  Last I heard the U.S Court of Appeals for the Ninth Circuit came out against bidding on a competitor's brand, but one judge wanted to have the full court review the decision.

Re: AdWords - 30 Conversion Goals.  This seems similar to setting goals in Google Analytics.  Do you think setting these AdWords conversion goals is worth it if you are tracking them already in Google Anallytics?  Thanks!

The key point is confusion.  The company had a product called "Smart Money Clip".  They had a trademark on that phrase.  Then another company puts up an AdWords ad with the headline, "Smart Money Clip".  That will CONFUSE people, just like if I opened a burger stand and called it McDonalds.  It's OK to say, This is better than the Smart Money Clip.  What you can't do is use someone else's trademark in a way that confuses people into thinking that you are McDonalds when you are not, or that you are selling the famous Smart Money Clip when you are not.

ARK,

It's interesting to read such a high quality presentation comparing search engines and strategies.

Are there strategy considerations you can describe regarding the differences between business to consumer PPC vs. business to business PPC?  Perhaps this is a topic for another article, or maybe you've already written something about it?

Excellent example of landing page change causing quality score change, and clearly presented.

If you made no other changes, then a better quality score should cause your text ad to appear higher on the page, right?

I'm wondering if your Avg. Position for the week after the change is higher than for the week before the change.

Does this mean it's a good idea for AdWords advertisers to bid on their brand name, even where they are at the top of the organic listings?
